Frank C. Quesada is the Chief Legal Officer of the MSP Recovery Law Firm. Quesada focuses his practice on health care litigation and, particularly, representing MSP Recovery, a data analytics company that purchases health insurance companies’ recovery rights stemming from their improper payments. Quesada oversees 30+ attorneys in-house and over 22 nationally recognized law firms that assist the MSP Recovery Law Firm in their efforts.
In 2017, Quesada participated in successfully certifying the first class action related to the Medicare Secondary Payer Act’s double damages provision. MSPA Claims 1, LLC v. In August of 2016, Quesada participated in two federal appellate court decisions (1) Humana v. Western Heritage, 832 F.3d 1229 (11th Cir. 2016) and (2) MSP Recovery v. Allstate, 835 F.3d 1351 (11th Cir. 2016). In Western Heritage, Quesada filed an amicus curie brief in favor of Humana. The court ruled in favor of Humana and expanded the analysis of the Medicare Secondary Payer Act and a health plan’s ability to prevail on such a claim. In the Allstate matter, MSP Recovery prevailed as the federal appellate court identified when lawsuits pursuant to the MSP Act are ripe for prosecution.
Throughout his career, Quesada has represented companies in a variety of complex commercial litigation cases and trials in both state and federal courts. He has helped formulate strategies for claims involving contracts, warranties, fraud, business torts, breaches of fiduciary duty, conspiracy, products liability and the like. Additionally, he has experience in juror research in anticipation of trial.
As a law student, Quesada was a law clerk with Chief Judge of The Third District Court of Appeal, Juan Ramirez, Jr., and with The Honorable Ronald Dresnick of the Eleventh Judicial Circuit. Additionally, Quesada served as an Intern with the Miami-Dade State Attorney’s Office where he was co-counsel on several jury and bench trials representing The State of Florida.
